Harlen Website Terms of Use
The Harlen website is operated by COAR Property Management, Inc., a California licensed real estate broker, CA DRE Lic No 02078336 ("COAR," "we," or "us"). Contact Cory Bergamini, CA DRE Lic No 02143616 at cory@coarpm.com. COAR general office: (562) 528-3115. Mailing address: 2883 E Spring St, Suite 150, Long Beach, CA 90806.
1. Website use and acceptance
These Terms address use of www.harlen.co and its account, rental-search, saved-home, messaging, and related digital features (the "Website"). They become a contract between you and COAR when you affirmatively agree to them through an acceptance control that clearly identifies these Terms, or through a signed agreement incorporating this version. A footer link, a visit to the Website, or an ordinary inquiry does not by itself establish your agreement to contractual restrictions. Applicable law continues to protect intellectual property, prohibit unauthorized access, and govern our conduct regardless of whether a contract has been formed.
If you accept for an organization, you confirm that you have authority to bind it. You must have legal capacity to enter an agreement, ordinarily by being at least 18, or act through an authorized representative where lawful. This provision does not restrict lawful housing access or exclude households with children.
2. Brokerage services and separate agreements
COAR provides licensed real estate services as well as the Website. These Terms cover Website use; they are not a lease, property-management agreement, brokerage engagement, screening authorization, or consent to dual representation. Opening an account, viewing a listing, or making an initial inquiry does not by itself create an exclusive brokerage relationship. Duties arising from COAR's actual conduct or applicable law still apply.
The property owner's identity, COAR's role, compensation, and any required agency disclosures belong in the applicable property-specific transaction documents. Any dual representation requires the disclosures and informed consent required by law; these Terms do not provide that consent. COAR does not become the property owner by operating this Website. The owner makes leasing decisions unless a valid property-management agreement delegates that authority to COAR.
3. Accounts and communications
Provide accurate account information, keep contact details current, and protect your sign-in methods. Do not impersonate another person or access an account without authorization. Report suspected unauthorized use to cory@coarpm.com. You are responsible for activity you authorize; this does not make you automatically responsible for a security failure outside your control.
We may contact you about account security, your inquiry, a requested service, or an active transaction through an appropriate contact channel, subject to applicable law and your permissions. Providing an optional phone number with a callback request allows us to respond to that request; it does not enroll you in an automated marketing or advertising-text program. Accepting these Terms does not authorize a consumer report, a payment, sale of personal information, or unrelated marketing. Separate notices and permissions apply where required.
4. Listings, search order, and tours
Listings may come from participating MLS brokerages or providers submitting properties directly. A source label identifies the source channel. Unless a particular statement describes a completed check, it does not mean COAR has inspected the property, independently verified every fact, or confirmed that it remains available.
Descriptions, photographs, prices, dimensions, amenities, map locations, and dates can change or contain errors. Confirm material details, total required charges, lease conditions, access needs, and availability before making a rental decision. See the Listing Information and Advertising Policy. These notices do not excuse deceptive advertising, misrepresentation, or any investigation or disclosure that COAR must perform under law.
Search results do not necessarily include every rental in a market. Results depend on participating sources, filters, available information, and ordering. Harlen Direct listings may receive priority in search results. COAR may receive fees from direct-listing owners or leasing commissions from other brokerages. Placement and source labels are not guarantees that a home is suitable for you or independently verified.
A tour request is not a confirmed appointment until separately confirmed. Saving a home does not reserve it or take it off the market. A listing, inquiry, or application does not guarantee approval, a lease, a price, or a move-in date. Neighborhood information provides general context and may not describe current conditions at an individual address.
5. Charges and rental applications
Rental search and tour coordination through the Website carry no renter brokerage fee. Rent, deposits, application-screening charges, and other lawful, disclosed property-specific costs are separate. Any additional paid service requires a separate agreement describing its charge.
COAR processes its rental applications through its AppFolio workflow. COAR's standard application-screening charge is $65 per adult individual per application, subject to actual-cost limits, legal caps, exceptions, and required refunds. The applicable process must provide the amount, recipient, screening criteria, refund rules, required authorizations, and privacy information before submission or payment. Other owners or agents may use a different application process and fee schedule.
These Terms do not authorize a charge or consumer report and do not make a fee nonrefundable. AppFolio's involvement does not replace COAR's legal responsibilities for its own application and screening activities.
6. Permitted use and prohibited conduct
Use the Website for lawful rental-related purposes. MLS listing information is provided for consumers' personal, noncommercial use to identify prospective properties, subject to applicable source notices. COAR, listing contributors, and licensors retain their respective rights in their content.
Without permission or a right provided by law, do not reproduce or commercially redistribute listing databases or photographs, remove attribution, harvest personal contact information, bypass access controls, misuse another account, introduce malicious code, or disrupt the Website. Do not use automated tools to evade access restrictions. Reasonable accessibility tools and indexing that COAR expressly permits are allowed.
Do not submit fraudulent, infringing, threatening, unlawfully discriminatory, or otherwise unlawful material. These restrictions do not prevent truthful reviews, lawful reports to regulators or law enforcement, legally protected investigations, or the exercise of privacy, fair-housing, accessibility, or other statutory rights.
7. Content you submit
You retain any ownership rights you have in your submissions. When you agree to these Terms, you grant COAR a nonexclusive, royalty-free license to store, transmit, format, and use your submissions as reasonably necessary to provide the service you request, administer your account, and meet legal obligations. This license does not permit public advertising of private messages or unrelated promotional use of your identity.
Public property advertising requires the provider's separate listing authorization. Uploading a draft alone does not authorize publication of the property. You must have lawful authority to provide submitted material and must not disclose another person's confidential information without that authority.
Report a content-rights concern to cory@coarpm.com, identifying the material, its Website location, your rights, and a way to contact you. We may seek supporting information or restrict disputed material while reviewing a complaint.
8. Privacy and outside services
Our Privacy Policy explains information collection, use, disclosure, retention, and requests relating to the Website. Making that policy available or acknowledging it does not waive privacy rights or provide blanket consent to optional processing.
We use outside services for functions such as authentication, hosting, storage, email delivery, security, analytics, and maps. Separate application services can involve additional notices. A link to another service does not guarantee its performance or replace its applicable terms. COAR remains responsible for its own conduct and legal obligations; another provider's terms do not silently amend your brokerage agreement with COAR.
9. Service changes and account closure
We may maintain, change, or discontinue Website features and restrict access for a material violation, security concern, suspected fraud, or legal obligation. Where practical and appropriate, we will explain a restriction and allow correction or review. Immediate action may be necessary when delay would create a material risk.
You can request account closure or review of an access restriction at cory@coarpm.com. Closing an account does not automatically delete every record, terminate a lease or separate brokerage agreement, forfeit funds, or remove privacy rights. Records may remain subject to the purposes and obligations described in the Privacy Policy. Contact us for assistance with an active transaction or records you are entitled to receive if Website access is unavailable.
10. Technology availability and limits
We provide the Website's technology on an "as available" basis. We do not promise uninterrupted operation, error-free software, or compatibility with every device. Keep copies of important transaction documents and report material technical problems promptly.
For a claim arising solely from Website technology failure and seeking only economic loss, COAR excludes liability for indirect or consequential loss, including lost business profits, only to the extent that exclusion is lawful and enforceable.
The exclusion does not apply to brokerage, management, screening, or leasing services; personal injury or property damage; fraud, willful misconduct, gross negligence, or a violation of law; or any liability or remedy that cannot lawfully be excluded. It does not limit fair-housing, privacy, accessibility, fiduciary, landlord, or other nonwaivable duties. Ordinary legal rules govern when the exclusion is unlawful or inapplicable.
11. Unlawful submissions and third-party claims
To the extent permitted by law, you are responsible for proven losses and reasonable defense costs attributable to your intentional misconduct or knowingly false claim of authority when that conduct causes a third-party claim that submitted material infringes rights or was unlawfully disclosed. This does not include losses caused by COAR's fault, a use outside your authorization and control, a good-faith consumer review, or a protected complaint.
COAR must give prompt notice of the claim, reasonably cooperate, and allow meaningful participation in the response. Neither side may agree to admissions, payment obligations, or other restrictions binding the other without that party's consent. An allegation alone does not require you to advance COAR's defense costs.
12. Disputes and general terms
California law applies, subject to overriding law. Claims may be brought in courts with lawful jurisdiction in Los Angeles County, California, except where consumer protections, mandatory venue rules, or other law require or permit another forum. Small-claims rights remain available. These Terms impose no mandatory arbitration, class-action waiver, jury waiver, or shortened claim deadline. They add no prevailing-party attorney-fee clause for disputes between you and COAR; the limited third-party defense-cost provision in section 11 is separate.
You may contact us to seek an informal resolution, but doing so is not a prerequisite to legal or regulatory action and does not change a filing deadline without a separate valid agreement or applicable law.
Materially changed contractual obligations apply to an existing user only after legally sufficient notice and acceptance; merely posting revised Terms does not establish that acceptance. Changes operate prospectively and do not alter an accrued claim without an express, lawful agreement.
Applicable law controls first. Property-specific agreements and required disclosures govern their subject matter, and these Terms govern Website technology use where a contract has been formed. These Terms do not supersede a signed brokerage or management agreement. If a provision cannot be enforced, the remaining lawful provisions continue where they can operate independently. A failure to enforce a provision is not a continuing waiver. Neither party may transfer obligations in a way that reduces the other's rights without legally sufficient authority or consent.
